Tullwood Apartment owners weary of Bellingham’s proposed summary judgement

BELLINGHAM, WA (MyBellinghamNow.com) – The owners of an apartment complex near the Bellingham Walmart encampment are speaking out ahead of a pivotal hearing.

Attorneys for the Tullwood Apartments say that they are not fully satisfied with the City of Bellingham’s proposed summary judgement. In new court documents filed on Sept. 20, they accused the city of not having a plan in place to relocate residents of the encampment within a reasonable timeframe.

Under the proposed summary judgement filed last week, the city would assume legal responsibility for the property if owner Li-Ching Fang does not clear it out by the end of this year.

Tullwood’s attorneys argue that Fang likely will not adhere to any new deadline set by the city, and that a winter deadline will make it difficult to relocate people living on the property. Fang, a resident of Taiwan, hasn’t submitted any court documentation in relation to the city’s case against her since March of this year.

The summary judgement hearing is scheduled for the morning of Sept. 25.
