Nitro Circus Contest Rules


KPUG and Nitro Circus want to send you and a friend to the Nitro Circus: You Got This Tour! For a chance to win tickets, listeners must tune into KPUG between December 10th through December 20th during the Dan Patrick show weekday mornings from 9am to 12pm PST for Mark Scholten to give a keyword during the commercial break. The keyword of the day will be the cue to call during The Zone that afternoon between 3pm and 4pm and the winner must be the 3rd caller to win a pair of tickets to Nitro Circus: You Got This Tour. Caller three at (360) 734-1170 will have the opportunity to play. If, for any reason, caller three is disconnected or does not successfully win the contest, we will move onto caller four, caller five, etc., in succession.

Each winner will receive a prize of a pair of seats to see Nitro Circus: You Got This Tour.

Winners between December 10th and December 13th will win tickets to see Nitro Circus performing on Saturday, May 9th, 2020 at Rotary Stadium, Discovery Trail, Abbotsford, BC V2T 4Y6, Canada.

Winners between December 16th and December 20th will win tickets to see Nitro Circus performing on Friday, May 8th, 2020 at Evergreen Speedway, 14405 179th Ave SE, Monroe, WA 98272

The winners on each Friday will win VIP tickets to their respective week’s show.

Total value of the prize is $95 USD, as stated by contest sponsors. Each individual ticket has a prize value of $47.50 USD.

The prize will be awarded to the first person to correctly complete the contest between 3pm-4pm each weekday from December 10th through December 20th. KPUG will make reasonable efforts to award prizes prior to May 8th, 2020

No purchase necessary. KPUG has no responsibility in connection with the prize. Winners will be responsible for all federal and state taxes, and any fees, incidentals, or documents provided by Second Street. Prizes are not transferrable or redeemable for cash.

KPUG contests are open to all eligible Washington state residents, age 18 or older, that have not won anything on KPUG in the past 30 days or any prize valued at $600 or more in the past 6 months. Only one winner per household is permitted within 30 days after a household has a winner. Any prize awarded to an ineligible listener will be deemed null and void, and an alternate eligible winner may be named.

Employees of KPUG, Saga Broadcasting, LLC dba Cascade Radio Group, and its ultimate parent company, Saga Communications, Inc., their advertising agencies, affiliates, contest sponsors, employees and immediate families of each, and employees of all media of mass communication within a one-hundred-mile radius of the KPUG main studio are not eligible to win any contest.  Immediate family includes the spouse, great-grandparents, grandparents, parents, brothers, sisters, children, grandchildren, and great-grandchildren of the employee and his/her spouse. This also includes individuals for whom the employee is current legal guardian.

These are the rules governing all contests aired on 1170 KPUG radio and on the kpug1170.com website or 1170 KPUG mobile app, unless otherwise specified. In the following rules, “1170 KPUG” means Pacific Northwest Media Group, which owns 1170 KPUG radio:

  1. No purchase is necessary to enter any 1170 KPUG contest.
  2. To be eligible to win any prize on 1170 KPUG you must not have won anything on 1170 KPUG in the past 30 days or any prize valued at $600 or more in the past 6 months. Only one winner per household is permitted within 30 days after a household has a winner. Any prize awarded to an ineligible listener will be deemed null and void, and an alternate eligible winner may be named.
  3. Anytime you call the 1170 KPUG studios you assume that your call will be broadcast or recorded and you grant us permission to broadcast the call or record it for later broadcast.
  4. As a winner of a 1170 KPUG contest your voice, name and/or picture may be used for promotional, broadcast, or internet purposes without any compensation to you.
  5. Prizes awarded are not redeemable for cash. No prize is transferable. No substitution for a prize will be made at the request of winner. 1170 KPUG reserves the right to substitute a prize of similar value.
  6. All winners of all contests are responsible for all taxes on prize awarded. All winners of a prize valued at $600 or more will be required to complete the appropriate tax forms at the 1170 KPUG studios prior to claiming prize. All winners will be sent a 1099 MISC federal tax form if in one calendar year the prize value of all prizes won exceeds $600.
  7. In the event the winner is subject to or the subject of any order or legal process issued by any governmental agency having jurisdiction over the affairs of the winner (i.e. garnishment, child support order, judgment, lien, and the like), 1170 KPUG’s delivery of the prize to the official representative of the governmental entity claiming a right to the prize shall be thus deemed as (1170 KPUG) awarding the prize to the winner. 1170 KPUG shall be entitled to rely in good faith, upon any documents presented by the representative seeking to collect the prize in lieu of the winner. 1170 KPUG shall not be liable for any claim by any winner for damages incidental thereto.
  8. All 1170 KPUG contests are open to all eligible residents 18 or over (unless otherwise specified) living within 75 miles of station transmitter(s). Contestants must possess a valid form of identification bearing the picture of the contestant acceptable to 1170 KPUG that will be presented to 1170 KPUG and accepted before the prize is awarded. Employees of 1170 KPUG, it's advertising agencies, affiliates, contest sponsors, employees and immediate families of each, and employees of all media of mass communication within a one hundred mile radius of the 1170 KPUG main studio are not eligible to win any contest. Immediate family includes the spouse, great-grandparents, grandparents, parents, brothers, sisters, children, grandchildren, and great-grandchildren of the employee and their spouse. This also includes individuals for whom the employee is current legal guardian.
  9. Winners will be expected to claim prize at the 1170 KPUG studios, 2219 Yew Street Road, Bellingham, Washington 98226, between 12:00pm – 5:00pm, Monday through Friday (excluding holidays) within 30 days of being notified that they are winners, unless there is an expiration date on prize, which will be specifically stated.
  10. Where the prize(s) consists of paper tickets (“will-call tickets”) the winner will be directed to go to a specified address and retrieve the will-call tickets, and, by entering the contest, the contestant agrees to pick up will-call tickets and sign and deliver to 1170 KPUG a waiver form as directed. Where the prize(s) consists of electronic (digital) concert or event tickets (“e-tickets”), the winner will receive an email from 1170 KPUG with a hyperlink to an electronic waiver form that the winner must sign and return to the 1170 KPUG before the prize will be transferred to the winner. The e-tickets will be transferred to the winner by 1170 KPUG or, in some cases, by a third party (for example, Ticketmaster, Live Nation, etc.) and the winner must check his or her email account for an email or cellular mobile number for a text message from the ticket provider in order to download the e-tickets. Where e-tickets are a prize, as a condition of entering the contest, redeeming and using e-tickets requires the winner (i) to have a valid email address and an app-enabled mobile device capable of downloading and running a third-party mobile ticketing app (e.g., Ticketmaster, Live Nation, etc.); (ii) to install, or have already installed, such mobile ticketing app on their app-enabled mobile device; and (iii) to log into an existing user account or sign up for a free user account with the third-party operating such mobile ticketing app by completing a form with all required information, including, at a minimum, the winner's first name, last name, valid email address and telephone number. E-tickets awarded as a prize in such contests cannot be redeemed or used by any means other than the designated third-party mobile ticketing app for the e-tickets. Individuals who do not have a valid email address, access to an app-enabled mobile device and/or do not comply with these requirements will not be able to redeem or use e-tickets should they be selected and verified as a winner, will not receive a substitute prize, and should not enter contests where e-tickets are the prize.
  11. 1170 KPUG reserves the right to disqualify any entrant if any contest rules are violated in any way.
  12. 1170 KPUG assumes no liability for situations, repairs, or incidents arising from any aspect of any prize awarded in any contest. 1170 KPUG, its advertising agencies, affiliates, contest sponsors, employees, and immediate families of each are absolved and shall be held harmless from any action or liability arising from any contest or prize awarded in any contest.
  13. As a licensee of the FCC and a trustee of the public airwaves, 1170 KPUG reserves the right to interrupt and/or discontinue any contest or promotion (and not award the offered prize) at the discretion of 1170 KPUG management if world events, the national mood, or public safety so warrant.
  14. 1170 KPUG reserves the right to amend the rules to any contest at any time. 1170 KPUG's decision is always final. In the event any one of the general contest rules which govern all 1170 KPUG contests contradict with any specific contest term, the specific contest term will control.
  15. For any contest requiring phone entry you must use only the following number unless otherwise specified: 360-734-1170. For texting it is 360-734-1170. The person processing inbound calls and/or texts at 1170 KPUG has the final decision as to who is the winning entrant.
  16. 1170 KPUG shall have no responsibility for contestant’s inability or failure to participate, failure to win or claim any prize based on malfunction or difficulties with telephone, cell phone, texting, email, mobile applications, internet access, or any other circumstances in any contest beyond 1170 KPUG’s control.
  17. For any contest involving on-line voting: If an entrant receives irregular votes, including but not limited to, votes generated by a robotic, programmed, script, macro, or other automated means, 1170 KPUG reserves the right to disqualify the entrant in its sole discretion and/or use another means to determine the winner(s), ex. – random selection or appointing a panel of judges.
  18. For any contests involving tickets to live performances or events, winners will need to follow all health and public safety guidelines and protocols put in place by the concert organizer.
  19. 1170 KPUG is not responsible for any event cancellations or reschedules.
  20. 1170 KPUG is not responsible for:
    • internet crashes or slowdowns caused by network congestion
    • viruses
    • sabotage
    • satellite failures
    • phone line failures
    • electrical outages
    • natural or man-made disasters
    • lost, late, misdirected, postage-due, unintelligible, returned, or undelivered entries or email
    • lost, interrupted, or unavailable satellite, network, server, Internet Service Provider (ISP), website, or other internet connections, providers, or platforms
    • failed telephone, satellite or cable hardware or software or lines, or jumbled, scrambled, delayed, or misdirected transmissions
    • computer hardware or software malfunctions, failures, or difficulties
    • other errors of any kind whether human, mechanical, electronic, or network

    Persons who tamper with or abuse any aspect of this contest or website, or act in violation of the official service, as solely determined by the station, will be disqualified. Neither sponsor nor promotion parties are responsible for any incorrect or inaccurate information whether caused by website users, tampering, hacking, or by any of the programming or equipment associated with or used in this contest, and assume no responsibility for any errors, omissions, deletions, interruptions or delays in operation or transmission or communication line failure, theft or destruction or unauthorized website access.

    1170 KPUG is not responsible for injury or damage to participant’s or any other person’s computer or property related to or resulting from participating in this contest. Should any portion of contest be, in 1170 KPUG’s sole opinion, compromised by virus, worms, bugs, unauthorized human intervention (i.e., hackers) or other causes which, in the sole opinion of the station, corrupt or impair administration, security, fairness or proper play of this contest, or contest plays, 1170 KPUG reserves the right at its sole discretion to suspend, modify or terminate the contest.

  21. 1170 KPUG has not made nor is in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Any and all warranties and/or guarantees on prize (if any) are provided only by the manufacturer, and winners agree to look solely to such manufacturers for any such warranty and/or guarantee.
  22. The following are specifically related to E-contests and E-Mail Club promotions on kpug1170.com:
    1. All appropriate information in required fields must be entered correctly and completely or you will be disqualified.
    2. To win a prize you must reside within the listening area of 1170 KPUG as defined at the exclusive discretion of 1170 KPUG management.
    3. Any problems with the internet or email are not 1170 KPUG’s responsibility.
    4. Contestants who register to participate on our website may be required to produce a printed copy of proof of registration before being allowed to participate in the contest.
    5. Due to the nature of our programs that are heard on-line over the internet, contests may not be heard at all on 1170 KPUG. Contests heard on the radio station’s internet audio stream may be slightly delayed from the time the contests are heard on the broadcast station, and will be running behind the broadcast signal. Thus, all contests heard on the internet are delayed. This delay can last for as much as 30 seconds or more. This means that when 1170 KPUG contests are played that require a specific caller to telephone the radio station (such as “Caller number 9 when you hear the sound effect”), listeners to the on-line audio stream may be at a disadvantage in participating over those listeners who hear the contests on-air.
