Whatcom Man Sentenced In Sexual Assault On Disabled Woman



WHATCOM, Wash.  (Metro)  -- A Whatcom County man who sexually assaulted a disabled woman is being sentenced to time served. 

Fifty-four-year-old David Wayne "Bear" Pen took a plea deal and had charges of rape dropped to fourth-degree assault with a sexual motivation. 

In December of last year, Pen assaulted his 18-year-old victim in a trailer near Paradise. 

Family told investigators the woman is "mentally retarded and autistic to a high end." 

Pen had been in jail for ten months awaiting trial, and is no longer in custody.
