SAN DIEGO (AP) — Score one for Google Glass — the high-tech eyewear some fortunate few have been sporting.

A traffic court in San Diego has tossed a citation against a woman authorities said was driving while wearing the computer-in-a-pair-of-eyeglasses device.

The court rejected the case because the code that Cecilia Abadie was cited for requires proof the device was in use.

The commissioner found there was no proof beyond a reasonable doubt the device was on when the woman was pulled over. Abadie is believed to be the first motorist cited for wearing Google Glass while driving.

Abadie is a software developer who is among some 30,000 people called “explorers” who have been picked to try out Google Glass before the technology becomes widely available to the public later this year.
